R (Carson) v Secretary of State for Work and Pensions [2005] UKHL 37 案,以及欧洲人权法院大审判庭(Grand Chamber)在 Carson and Others v United Kingdom(2010年)案中以11票对6票,均认定不构成违法歧视。1819

GOV.UK “State Pension if you retire abroad”及“Voluntary National Insurance”页面(2026至2027纳税年度规则),以及《2014年养老金法》第20条。

(Department for Work and Pensions,DWP)下属的国际养老金中心以电话或寄送国际申请表的方式申领英国国家养老金,且须在距国家养老金领取年龄4个月以内提出。

GOV.UK用一句话说明这一规则:“You must be within 4 months of your State Pension age to claim.”(须在距国家养老金领取年龄4个月以内申领。)

GOV.UK要求领取人只选择一个支付国:“You cannot be paid in one country for part of the year and another for the rest of the year.”(不能一年中部分时间在一国领取、其余时间在另一国领取。)

GOV.UK原文明确规定:“Your State Pension will only increase each year if you live in: the European Economic Area (EEA), Gibraltar, Switzerland, countries that have a social security agreement with the UK (but you cannot get increases in Canada or New Zealand). You will not get yearly increases if you live outside these countries.”(只有居住在欧洲经济区、直布罗陀、瑞士或与英国订有社会保障协定的国家,国家养老金才会每年上调,但在加拿大或新西兰不能获得上调;居住在上述国家以外的,不获年度上调。)

第(1)款规定,“regulations may provide that an overseas resident who is entitled to a state pension under this Part is not entitled to up-rating increases”(条例可规定,依本部分享有国家养老金的境外居民无权获得上调);第(2)款将境外居民界定为“not ordinarily resident in Great Britain or any other territory specified in the regulations”(不通常居住在大不列颠或条例指定的其他地区)的人。 GOV.UK的表述是:“Your pension will go up to the current rate if you return to live in the UK.”(返回英国居住的,养老金将提高至现行标准。)

GOV.UK的原文是:“Your payments may be suspended if you do not send the form back.”(如不寄回表格,付款可能被暂停。)

自2026至2027纳税年度起,“You cannot pay voluntary Class 2 National Insurance contributions for time abroad”(不得就境外期间缴纳第2类自愿国民保险缴款),而就2026年4月5日以后的境外期间缴纳第3类,须“previously lived in the UK for 10 years in a row”(曾在英国连续居住10年)或“paid 10 years of qualifying National Insurance contributions in total”(累计缴纳10年合格国民保险缴款)。

GOV.UK对境外居民的一般说明是:“You may be taxed on your State Pension by the UK and the country where you live.”(您的国家养老金可能被英国和您的居住国同时征税。)16

消除双重征税的依据是第23条第3款:“United Kingdom tax payable in accordance with this Convention in respect of income from sources within the United Kingdom shall be allowed as a credit against Thai tax payable in respect of that income”(依本协定就来源于英国的所得应缴的英国税款,应准予抵免该项所得应缴的泰国税款),抵免额以该项所得对应的泰国税额为限。

依第19条第2款(a)项,英国“in respect of services of a governmental nature”(就政府性质的服务)支付的养老金“shall be taxable only in that State”(应仅在该国征税);依第19条第2款(b)项,领取人为泰国“a national of and a resident of”(国民兼居民)的,该养老金仅在泰国征税。 国家养老金不属于此类养老金:它依国民保险制度支付,并非“in respect of services of a governmental nature”。

R (Carson) v Secretary of State for Work and Pensions [2005] UKHL 37 案及2010年3月16日欧洲人权法院大审判庭 Carson and Others v United Kingdom 案中对冻结提出挑战。

霍夫曼勋爵(Lord Hoffmann)拒绝与私人养老金计划类比:“national insurance contributions are little different from general taxation which disappears into the communal pot of the consolidated fund.”(国民保险缴款与进入统一基金公共资金池的一般税收几无区别。)

判决第84段认定“NICs have no exclusive link to retirement pensions”(国民保险缴款与退休养老金之间不存在专属联系),第90段得出结论:居住在未与英国订立养老金上调互惠协定国家的领取人,并非“in a relevantly similar position to residents of the United Kingdom or of countries which are party to such agreements”(与英国居民或协定缔约国居民处于相关相似的地位)。

Lord Hoffmann, under the heading "State and private pensions": "It is, I suppose, the words 'insurance' and 'contributions' which suggest an analogy with a private pension scheme. But, from the point of view of the citizens who contribute, national insurance contributions are little different from general taxation which disappears into the communal pot of the consolidated fund." Lord Walker quoted the first-instance judgment of Stanley Burnton J ([2002] 3 All ER 994, 1014, para 73): "a government may lawfully decide to restrict the payment of benefits of any kind to those who are within its territorial jurisdiction, leaving the care and support of those who live elsewhere to the governments of the countries in which they live." Lord Carswell, dissenting, would "allow the appeal and declare that regulation 3 of the Social Security Benefits Up-rating Regulations 2001 (SI 2001/910) is unlawful". ↩

Paragraph 84: "Unlike private pension schemes, where premiums are paid into a specific fund and where those premiums are directly linked to the expected benefit returns, NICs have no exclusive link to retirement pensions." Paragraph 90: "the Court does not consider that the applicants, who live outside the United Kingdom in countries which are not party to reciprocal social security agreements with the United Kingdom providing for pension uprating, are in a relevantly similar position to residents of the United Kingdom or of countries which are party to such agreements."
